Welcome to BPJL Gaming. These Terms of Service ("Terms") govern your access to and use of the BPJL Gaming website, and the purchase of any products through it (the "Site"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

  • You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on the Site.
  • By using the Site, you confirm that the information you provide is accurate and that you have the legal capacity to enter into a binding contract.

3. Products

  • BPJL Gaming sells trading card game (TCG) products and accessories, including but not limited to singles, sealed booster packs/boxes, playmats, sleeves, deck boxes, and related accessories.
  • All product images are for illustrative purposes. Actual card condition (for singles) will be described using standard grading terms (e.g., Near Mint, Lightly Played, Moderately Played, Heavily Played, Damaged) at the time of listing.
  • We make every reasonable effort to display accurate colours, artwork, and descriptions, but slight variations may occur due to printing runs, screen settings, or manufacturer changes.
  • Sealed product is sold as-is from the manufacturer; BPJL Gaming does not guarantee the contents (e.g., pull rates, specific cards) of sealed packs or boxes.
  • Trademarks, card names, artwork, and franchise properties referenced or depicted on the Site (e.g., game names, set names) belong to their respective owners. BPJL Gaming is an independent retailer and, unless stated otherwise, is not affiliated with, endorsed by, or officially connected to the publishers or rights holders of these products.

4. Pricing & Availability

  • All prices are listed in South African Rand (ZAR). BPJL Gaming is not a registered VAT vendor, and prices do not include VAT.
  • Prices are subject to change without notice, but changes will not affect orders already confirmed.
  • We make reasonable efforts to ensure stock levels and pricing are accurate. In the event of a pricing error or stock unavailability after an order is placed, we will contact you to offer a correction, substitution, or full refund.
  • We reserve the right to limit order quantities on high-demand or restricted items (e.g., new set releases).

5. Orders & Payment

  • By placing an order, you are making an offer to purchase, which we may accept or decline at our discretion (e.g., in cases of suspected fraud, pricing errors, or stock issues).
  • Order confirmation via email does not guarantee product availability; final confirmation is provided once your order is processed.
  • Payment must be received in full before an order is processed and shipped, unless otherwise agreed.
  • We accept EFT, Yoco, and PayFast. All payments are processed through secure third-party payment gateways; BPJL Gaming does not store your full payment card details.

6. Shipping & Collection

  • We currently ship within South Africa only. Delivery and collection options, timeframes, and costs are set out in our [Shipping Policy].
  • Free collection is available from our Centurion, Pretoria location by prior arrangement only.
  • Risk in the products passes to you upon delivery or collection. Ownership passes once payment has been received in full.

7. Returns, Refunds & Cancellations

  • Please refer to our Refund & Returns Policy, available on our store, for full details.
  • Due to the collectible nature of our products, all sales are final once an order has been processed. We do not accept returns or exchanges for change of mind, incorrect purchases, buyer's remorse, or dissatisfaction with the randomised contents/pulls of a genuine product.
  • If your order arrives damaged, incorrect, or with an item missing, contact us as soon as possible after delivery with your order number, photographs, and a description of the issue, and we will investigate and determine the appropriate resolution.
  • Nothing in this section limits any rights or remedies you may have under applicable South African consumer law, including in respect of genuinely defective products.
  • To request a cancellation, contact us as soon as possible at orders@bpjlgaming.com. Once an order has been processed or shipped, we may be unable to cancel it.

8. User Accounts

  • If you create an account on the Site, you are responsible for maintaining the confidentiality of your login details and for all activity under your account.
  • You agree to notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse our platform or staff.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorised access to our systems, accounts, or data.
  • Interfere with the proper functioning of the Site (e.g., through bots, scraping, or denial-of-service attacks).
  • Submit false, misleading, or fraudulent information, including for payment or shipping purposes.
  • Resell products purchased from BPJL Gaming in a manner that misrepresents their origin, condition, or authenticity.

10. Intellectual Property

  • All content on the Site — including logos, text, graphics, and design (excluding third-party trademarks and card/game artwork referenced in Section 3) — is owned by or licensed to BPJL Gaming and may not be reproduced without permission.
  • You may not use our branding, product photography, or content for commercial purposes without prior written consent.

11. Limitation of Liability

  • To the maximum extent permitted by law, BPJL Gaming will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products.
  • Our total liability for any claim relating to an order will not exceed the amount paid for that order.
  • We are not liable for delays or failures caused by circumstances beyond our reasonable control, including courier delays, load-shedding, or force majeure events.
  • Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under South African law, including your rights under the Consumer Protection Act, 2008.

12. Consumer Rights

  • Nothing in these Terms affects your statutory rights as a consumer under the Consumer Protection Act 68 of 2008or other applicable South African law.

13. Privacy

  • Your personal information is collected and processed in accordance with our [Privacy Policy] and the Protection of Personal Information Act (POPIA).

14. Changes to These Terms

  • We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

  • These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site will be subject to the jurisdiction of the South African courts.
